Terms of Service

Welcome to Sable Monarch. Sable Monarch is a brand of Artup Media Private Limited, D-66, Ground Floor, Hauz Khas, New Delhi, Delhi — 110016, India (“Sable Monarch”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Sable Monarch website, mobile experience, AI design tools, and made-to-order garment service (collectively, the “Service”). By placing an order, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Eligibility and Minors

You must be at least 18 years of age, or the age of majority in your jurisdiction, to enter into a purchase contract. Where a user is under 18, any purchase made through their account is deemed to be made by, and contracts with, their parent or legal guardian, who accepts these Terms on the minor’s behalf.

Users aged 13–17 may use the design tools only after a parent or legal guardian confirms consent through the verification link we email them, as required by the Digital Personal Data Protection Act, 2023. For users under 18 we do not run profiling, behavioural tracking, or targeted advertising, and photo-upload features are unavailable. The Service is not available to children under 13. By using the Service you represent that the billing and shipping information you provide is accurate and belongs to you (or your parent/guardian).

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraud or abuse.

Designs, Intellectual Property, and Likeness Rights

  • Your designs. You retain ownership of original artwork you upload and of the prompts you write. You grant Sable Monarch a non-exclusive, worldwide, royalty-free licence to reproduce, modify, print, ship, and display those designs solely for the purpose of fulfilling your order and operating the Service.
  • AI-generated content. Designs produced by our AI tools are the result of probabilistic models. We do not guarantee they will be unique, copyright-clear, or free of resemblance to existing works.
  • Your responsibility — assented at checkout. Before any order is placed, you must affirm that you own — or have all necessary rights to — the design and any image, photograph, or content you uploaded; that it does not infringe any third party’s copyright, trademark, trade dress, or other intellectual-property right; and that you have permission to use the likeness of any identifiable person depicted. By the same act you authorise Sable Monarch to reproduce, print, ship, and display the design solely to fulfil your order, and indemnify Sable Monarch against any costs, losses, or liabilities resulting from a breach of this affirmation.
  • Digitised embroidery files. Where an order involves embroidery, your artwork is converted into a machine-readable stitch file (e.g. DST). You pay a one-time digitization fee covering a portion of that craft work; the digitised stitch file and all rights in it remain the property of Sable Monarch. We retain it so your design can be re-run on future orders at no repeat digitization cost; it is not supplied to you or any third party and is not for resale. Your ownership of the underlying artwork itself is unaffected.
  • Our platform. The Sable Monarch name, logo, garment templates, code, copy, photography, and overall visual identity are the property of Artup Media Private Limited and are protected by Indian and international intellectual-property law. The “Sable Monarch” mark is the subject of a filed trademark application. You may not copy, scrape, or republish them without written permission.

Prohibited Content

You may not use the Service to generate, upload, or order designs that:

  • infringe a third party's copyright, trademark, trade dress, or likeness / right-of-publicity, including but not limited to characters, logos, or other distinctive marks of films, TV shows, anime, manga, comics, games, books, music, sports teams, brands, or organisations;
  • depict a real, identifiable person (including celebrities, athletes, politicians, and creators) without their explicit written consent;
  • are sexually explicit, hateful, harassing, defamatory, or threatening;
  • promote violence, terrorism, illegal substances, or self-harm;
  • contain personal data of another individual without consent;
  • are unlawful in India or in your delivery jurisdiction.

To protect the platform and our customers, every design is reviewed by an automated IP / likeness classifier before generation, before any reference image is accepted, and again before any order is sent to print. Designs identified as referencing copyrighted characters, trademarked marks, or recognisable real people may be refused; borderline cases are routed to human review before manufacturing begins. Sable Monarch may refuse, cancel, or refund any order that does not meet this section, and may permanently suspend accounts that repeatedly attempt to circumvent these rules.

Notice and Takedown

If you believe a design generated, listed, or printed by Sable Monarch infringes a copyright, trademark, trade dress, or likeness right that you control, please file a notice using the form at sablemonarch.com/ip-complaint or by emailing ip@sablemonarch.com. A complete notice should identify the work you control, the material you allege is infringing, a good-faith statement that the use is not authorised, and a statement (under penalty of perjury, where applicable) that you are the rights-holder or are authorised to act on their behalf.

On receipt of a valid notice, we will acknowledge within 72 hours, halt the production of any pending orders containing the disputed material, remove the material from public-facing surfaces while we investigate, and keep a record of the notice and our response for our internal IP register. We reserve the right to forward the notice to the customer who submitted the design and to require independent verification of rights before reinstating any disputed material. Knowingly false claims may expose the complainant to liability for damages.

Orders, Pricing, and Payment

All prices are listed in Indian Rupees (INR). Artup Media Private Limited is presently below the GST registration threshold, so no GST is charged or collected separately and no tax invoice is issued. A flat processing fee (currently 2%) — covering secure payment processing and order handling — is shown as its own line on the order-review screen before you pay. Delivery charges, where applicable, are likewise shown before payment. The total displayed at the checkout step is the final price you pay; we do not add hidden fees beyond that point. All garments are made in India (country of origin: India).

Payments are processed by our payment provider. By submitting payment information you authorise us, through our payment provider, to charge the displayed amount. We do not store full card details on our servers.

Order confirmation does not constitute acceptance. We may refuse or cancel an order in cases of suspected fraud, content-policy violation, pricing error, or stockouts of materials, and will refund any amount already collected.

Production and Shipping

Each garment is made to order. Production begins shortly after payment is confirmed. The windows below are door-to-doorstep within India. DTF / DTG print orders typically take 6–7 days. Embroidery scales with the number of embroidered designs — one design takes 7–8 days, two designs take 10–12 days, and three or more take up to 15 days. Ethnic / atelier pieces are quoted and scheduled separately, anywhere from a few days up to around two months depending on the piece’s difficulty. Returns, Refunds, and Cancellations

Because every garment is custom-printed for you, we do not accept returns for change of mind, sizing (when within the size chart), or design preference. We do replace or refund defective and incorrect products. The full policy lives at Refund Policy.

Atelier Advances and Store Reservations

Atelier advance. Bespoke / atelier commissions require an advance before design work begins. The advance is a design-and-consultation fee: it pays for concept development, AI generations, and artisan consultation that start immediately. Once design work has begun, the advance is non-refundable if you cancel, decline the quotation, or do not respond. If we decline or are unable to fulfil your commission, the advance is refunded in full.

Ready-made store reservations. Reserving a piece from the Sable Monarch Collection holds it for you while we confirm payment and stock. A reservation is a request, not a concluded sale: the price shown at reservation is honoured once confirmed by us, and either party may cancel before payment is collected, in which case nothing is owed. Confirmed, paid store orders follow the Refund Policy.

Affiliate Program

Affiliate earnings are credited only after an order using your code is marked as delivered. The rate is a flat 5% of the sale value on every qualifying delivered order. Earnings are paid to the UPI or bank account you register and may be subject to applicable Indian tax-deducted-at-source rules.

NeuroMonarch by You — Creator Earnings

  • Listing. You may submit designs from your paid orders to the public NeuroMonarch by You catalogue. Every submission is reviewed (including automated IP / likeness checks) before it goes live, and we may decline or remove any listing at our discretion. Catalogue prices are set by Sable Monarch; any price you suggest is advisory only.
  • Royalty. When another customer’s order using your listed design is delivered, you earn a royalty on that sale’s value: 10% for a design’s first five counted sales, and 5% from its sixth sale onward (counted per design; refunded or cancelled sales do not count).
  • Hold and forfeiture. Royalties become payable 15 days after delivery of the underlying order. If that order is cancelled, refunded, or charged back during the hold, the royalty is forfeited. Payouts are made to the UPI / bank details you register and may be subject to applicable Indian tax-deducted-at-source rules.
  • Ownership. You retain ownership of your listed design and grant Sable Monarch a non-exclusive licence to display, reproduce, print, and sell garments bearing it for as long as it remains listed. You may request delisting at any time; orders already placed will still be fulfilled.

Wallet and AI Generations

AI design generations are billed against your Sable Monarch wallet at the per-generation price displayed at the time of use. Wallet credit is consumed on use and non-refundable except where required by law; promotional or bonus credit carries no cash value, is forfeited on account closure, and cannot be transferred or withdrawn. Wallet balances have no cash value outside the Service.

Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Sable Monarch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the AI tools will produce any specific result or that the Service will be uninterrupted or error-free.

Limitation of Liability

To the maximum extent permitted by law, Sable Monarch's aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi, India, without prejudice to your rights under the Consumer Protection Act, 2019.

Changes to These Terms

We may revise these Terms from time to time. The “Effective” date at the top reflects the most recent change. Material changes will be highlighted on the website or notified to you by email. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
